Democracy Gone Astray

Democracy, being a human construct, needs to be thought of as directionality rather than an object. As such, to understand it requires not so much a description of existing structures and/or other related phenomena but a declaration of intentionality.
This blog aims at creating labeled lists of published infringements of such intentionality, of points in time where democracy strays from its intended directionality. In addition to outright infringements, this blog also collects important contemporary information and/or discussions that impact our socio-political landscape.

All the posts here were published in the electronic media – main-stream as well as fringe, and maintain links to the original texts.

Maria Butina’s boyfriend claimed he set up Trump-Russia NRA "conduit" as campaign funds flowed


Admitted Russian spy Maria Butina’s Republican operative boyfriend wrote in private communications that he was involved in setting up a “very private line of communication” between Russia and the Trump campaign using the National Rifle Association as a “conduit.”

Butina, a 30-year-old Russian gun rights activist, worked for years to cultivate relationships within Republican and NRA circles. She was charged with working as an agent of the Russian government earlier this year and on Monday agreed to plead guilty to conspiracy charges and cooperate with prosecutors.

The NRA Would Like to Insure You Now

In March 2012, Joe Balistreri was visiting his parents in Foster City, a suburban community on the San Francisco Bay. Early in the morning, he heard the front doorknob rattle, followed by a commotion around the side of the house. Someone had jumped the gate. Balistreri woke his father and asked for a gun. In the dark, he confronted a tall stranger who had entered the house through an unlocked garage door. Balistreri fired three rounds, one of which hit the intruder, Patrick O’Neil, high in the chest, between the clavicles.

Appeals Court Says AR-15s Are Not Constitutionally Protected

AR-15s and other assault weapons with large magazines are not protected by the Second Amendment and can be lawfully banned, the Fourth Circuit Court of Appeals ruled on Tuesday.

The federal appeals court – based in Richmond, Virginia, and known for its conservative bent – upheld a Maryland prohibition of assault weapons in unvarnished language, writing that "the banned assault weapons and large-capacity magazines are not constitutionally protected arms."

McConnell: No New Supreme Court Justice Until The NRA Approves Of The Nominee

Supreme Court justices are nominated by the president and appointed with the advice and consent of the National Rifle Association, according to Senate Majority Leader Mitch McConnell (R-KY).

McConnell offered this unusual view of the confirmation process during an interview with Fox News Sunday. In response to a question from host Chris Wallace, who asked if Senate Republicans would consider the nomination of Judge Merrick Garland to the Supreme Court after the election if Hillary Clinton prevails, McConnell responded that he “can’t imagine that a Republican majority in the United States Senate would want to confirm, in a lame duck session, a nominee opposed by the National Rifle Association [and] the National Federation of Independent Businesses.”

The Gun Industry's Plan To Make It Easier To Buy A Silencer - The product is being rebranded as a hearing-protection device.

FAIRFAX, Va. (Reuters) - The U.S. gun industry is trying to shake off the Hollywood hitman image of the gun silencer and rebrand it as a hearing-protection device in a campaign to roll back regulations that date to the 1930s.

Industry lobbying has led to more than a dozen states legalizing silencers for hunting since 2011. Now gun advocates are pressing Congress to repeal a Depression-era law that requires a months-long screening process for silencer buyers - far more scrutiny than gun buyers face.

West Virginia Overrides Governor’s Veto To Pass Radical NRA-Backed Gun Law

Gun owners in West Virginia will no longer need to get a permit to have a concealed weapon, putting it among the most far-reaching states for gun rights. The House voted on the measure Friday and officially overrode a gubernatorial veto on Saturday.

The law, which does away with the permit and training program for people 21 and older who want to carry a concealed weapon, was supported by the National Rifle Association, but opposed by law enforcement across the state.

Hillary Clinton To Raise Money From Ex-NRA Lobbyist

WASHINGTON -- Hillary Clinton’s campaign will hold a fundraiser in Washington on March 21 that will feature as one of its hosts Jeff Forbes, who until the end of last year worked as a lobbyist for the National Rifle Association.

Forbes, a former chief of staff to former Sen. Max Baucus (D-Mont.), was registered as a lobbyist for the NRA Institute from 2009 until the end of 2015 on issues such as protecting Second Amendment rights, and regulation and gun control, according to lobbying disclosures. He donated $2,700 to the Clinton campaign in April when he was still registered to lobby against gun control. In addition, a colleague at his Forbes-Tate lobbying shop, Elizabeth Greer, also donated $2,700 while registered to lobby for the NRA.

Much of today’s opposition to stronger gun safety regulations rests on the gun lobby’s Hobbesian vision of self-sufficient, heavily-armed citizens standing up to vicious thugs. This Die Hard argument is constantly parroted by politicians and conservatives pundits. But the statistical reality is that for every justifiable homicide in the United States—for every lethal shooting in defense of life or property—guns are used to commit 34 murders and 78 suicides, and are the cause of two accidental deaths, according to an analysis of FBI data by The Washington Post.

New Harvard Research Debunks the NRA's Favorite Talking Points

Anyone familiar with the gun debate has heard the talking points of the National Rifle Association and other gun rights advocates: "Carrying a gun for self-defense makes you safer." Or: "If only more ordinary citizens were armed, they could stop mass shootings." As we've shown in our reporting, these arguments don't stand up to scrutiny. After the massacre at Sandy Hook Elementary School, David Hemenway, director of the Harvard Injury Control Research Center, commented on another long-running assertion from the gun lobby: "There is no evidence that having more guns reduces crime," he told the New York Times.

Lawmakers Sneak Big Gift To The NRA Into Bill Banning Copper Theft

“Secondary metal” theft, where someone sneaks onto a property that is under construction and steals copper wiring or other valuable metal, is a very real problem that increases the cost of housing and other real estate development. It also has virtually nothing to do with gun rights. And yet, Pennsylvania state Sen. Richard Alloway (R) successfully added a provision that is likely to amount to a financial windfall for pro-gun litigators onto a bill that was intended to protect against metal theft. The bill passed the state legislature and Gov. Tom Corbett (R) is expected to sign it.

The NRA Is Directly Behind A Bill Loosening Florida's 'Stand Your Ground' Law

Lawmakers are aiming to expand Florida's "stand your ground" law with the help of a top NRA lobbyist.

Gawker's Adam Weinstein reported that S.B. 448, which would protect someone who fires warning shots or waves a weapon when they feel threatened, was written by Marion Hammer, a former NRA president.

The bill would amend the current law, which permits residents to use deadly force under certain circumstances, to allow the "threatened use of force." Gun owners couldn't be arrested for brandishing a gun or firing warning shots. The legislation also could lead to more permissive open-carry laws or lighter requirements for gun licensing.

NRA Asks Supreme Court To Strike Down Gun Limits For Minors

In a Monday court filing, the National Rifle Association asked the U.S. Supreme Court to strike down a 1968 law that prevents licensed gun dealers from selling handguns to people between the ages of 18 and 21.

The NRA, along with two nineteen-year-olds, aims to overturn the federal law that restricts the sale of handguns and ammo to anyone under 21 years of age. While individuals between the ages of 18 and 21 cannot obtain a handgun from a licensed dealer per the law, they can still obtain a gun through other channels. The law also does not prevent individuals between 18 and 21 from obtaining shotguns and rifles.

"Because everyone who sells firearms on anything even approaching a regular basis must be federally licensed, this restriction precludes law abiding adults under the age of 21 from purchasing handguns from the most common (and most logical) sources," the filing reads.

In 2012, the first challenge to this federal gun law was rejected in the U.S. Court of Appeals for the Fifth Circuit. The court held that the age restriction was "consistent with a longstanding tradition of targeting select groups’ ability to access and to use arms for the sake of public safety.”

Perceived Threats

For some years, the N.R.A.’s approach to gun-rights advocacy has amounted to a variant of the old Maoist dictum, to the effect that democracy flows from the barrel of a gun. In March, the group provided a novel twist on the theme of sidearm liberty when it débuted an ad featuring Colion Noir, a young African-American in a low-slung baseball cap, who offered a series of one-liners to explain why he supports gun rights. First among his arguments is the idea that it is absurd for African-Americans to oppose gun access, given the history of racial violence that characterized segregation. Around the time the ad was released, the N.R.A.’s president, David Keene, told an interviewer that African-Americans should recognize that gun-control policy dates back to the attempts to disarm blacks after the Civil War. There’s a neat logic to the N.R.A.’s marketing push: the gun is an essential implement of democracy, so gun rights should appeal to people whose history has been defined by the struggle to achieve civil rights.

Neil Heslin Smeared By Connecticut Carry Gun Lobbying Group

WASHINGTON -- A Connecticut gun lobbying group on Wednesday personally attacked the father of a Sandy Hook school massacre victim, accusing him of "profitting off of the tragedy" and saying a decade-old drug arrest makes him a "poster boy" for background check ineffectiveness.

Connecticut Carry, a nonprofit gun lobbying organization, singled out Neil Heslin, whose son Jesse Lewis was killed in the December school shooting, in a press release. Heslin has testified before Congress and attended events at the White House with President Barack Obama in support of increased background checks for gun purchasers.

The N.R.A.’s Challenge to America

In case you missed the news—and I can’t really blame you for tuning it out—the National Rifle Association has gotten itself a new president. He’s a charming tub of a man by the name of Jim Porter, and Monday was officially his first day in his new job. But even before taking over at the N.R.A.’s headquarters, in Fairfax, Virginia, Porter clearly signalled his intentions.

Addressing the N.R.A.’s annual convention in Houston over the weekend, the sixty-four year-old Porter told the assembled firearms enthusiasts, survivalists, and Republican hangers-on that they were engaged in a “culture war” with the President, media élitists, Mayor Bloomberg, and anyone else who questioned the right of God-fearing Americans to arm themselves like members of an infantry battalion without a proper system of background checks on purchases. “This is not a battle about gun rights,” Porter declared at a breakfast meeting. “[You] here in this room are fighters for freedom. We are the protectors.”

Meet the New N.R.A. President

At the White House Correspondents’ Dinner, Conan O’Brien noted that Wayne LaPierre, the National Rifle Association’s front man, is merely its executive vice president, “which begs the question, how freaking crazy do you have to be to be the actual president of the N.R.A.?”

That’s not what begs the question means; the N.R.A.’s executive V.P. functions as a sort of chief executive officer; and it’s an easy joke. But as it happens the N.R.A. has just elected a new president, an Alabama lawyer named Jim Porter, and he’s, if not freaking crazy, certainly aggressively provocative.

Terror of terrorism and the Second Amendment: Whatever became of the indomitable American spirit?

We have learned, courtesy the news media, that membership in the National Rifle Association has surged past five million souls since the Sandy Hook Massacre of little children in Connecticut last December.

It would seem that a significant minority of our American cousins will let nothing stand in the way of their right to massive firepower, which they insist is protected by the Second Amendment of the U.S. Constitution.
